Wixams Town Council said it welcomed a court’s decision to refuse permission for a legal claim relating to its Annual Council Meeting last year.
A councillor had sought permission for a judicial review of the notice for the meeting, arguing that it was issued one day late.

But a second, separate claim has been given the go-ahead.
The town council’s statement said: “The court was clear that although the statutory notice period had been miscalculated due to a clerical error, there was no prejudice to any councillor or member of the public”.
The statement quoted the court as saying it was “impossible that any decision would be different.” On that basis, permission for that claim was refused.
The town council said it is “pleased” that the validity of the meeting and its decisions has been confirmed.

The statement also commented on what it called a “separate and more limited issue” relating to the suspension of a councillor’s email account.
The town council’s statement said the court had granted permission to proceed to a short hearing.

But it said the court “indicated” that this issue should be “capable of resolution” without the need for a full hearing.
As the matter is ongoing, the town council said it would “not be appropriate” to comment in detail.
It said it will comply fully with the court’s directions and will continue to act in accordance with proper governance and legal advice.
The town councillor has been approached for a comment.
